These terms govern your use of kodeark.com (the “Site”), operated by Kodeark (“Kodeark”, “we”, “us”, or “our”). By using the Site, you agree to these terms. If you don’t agree, please don’t use the Site.

These terms apply to your use of the Site itself. Any paid project we deliver for you — such as building, improving, designing, or adding AI to your product — is governed by the separate proposal or agreement we sign with you, which takes priority over these terms for that work.

Acceptance of these terms

By browsing the Site, submitting a form, or otherwise using it, you agree to be bound by these terms and our Privacy Policy. We may update these terms from time to time; continuing to use the Site after a change means you accept the updated terms.

Enquiries and project work

Submitting a form on the Site (for example, a contact enquiry or a project review request) is not a booking or a contract — it’s the start of a conversation. No project, retainer, or paid engagement begins until we’ve agreed scope, price, and timeline in writing and both parties have signed off on it.

Any content on the Site describing our services, process, pricing approach, or past work is for general information only and doesn’t form part of any contract unless we expressly say so in a signed agreement.

Intellectual property

Unless stated otherwise, everything on the Site — including text, graphics, logos, images, and code — belongs to Kodeark or our licensors and is protected by copyright and other intellectual property laws. “Kodeark” and our logo are our trademarks. Nothing on the Site grants you a licence to use them.

The Site may link to third-party websites or embed third-party content (for example, videos or social media). We don’t control these third parties and aren’t responsible for their content, availability, or privacy practices. Links are provided for convenience and don’t imply endorsement.

No warranties

Subject to that, Kodeark won’t be liable for any indirect or consequential loss, or for any loss of profit, revenue, data, or business, arising from your use of the Site. This doesn’t affect any separate liability terms agreed in a signed project agreement.

Governing law and jurisdiction

These terms are governed by the laws of England and Wales. Any dispute arising from these terms or your use of the Site will be subject to the exclusive jurisdiction of the courts of England and Wales.
