Kodeark (“Kodeark”, “we”, “us”, or “our”) is a product and software design agency. This policy explains what personal data we collect through kodeark.com (the “Site”), why we collect it, and the rights you have over it, in line with the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018.

By using the Site, you agree to the practices described in this policy. If you don’t agree, please don’t use the Site or submit your details to us.

Who we are

Kodeark is the data controller for the personal data described in this policy. We’re a small agency, so any question about your data reaches the people actually running the business.

The data we collect

We collect the following categories of personal data:

  • Contact details — your name, email address, and any company or website you tell us about, when you use a form on the Site (for example the contact form or a project enquiry).
  • Message content — whatever you write to us: your challenge, idea, project stage, timing, or product link.
  • Technical data — IP address, browser type, device type, operating system, and general location, collected automatically when you visit the Site.
  • Usage data — pages viewed, time on page, referring site, and how you interact with the Site, collected through analytics.

We don’t ask for, and don’t want you to send us, special category data (health, financial, or similarly sensitive information) through the Site.

How we collect your data

Directly from you, when you fill in a form on the Site, book a call, or email us at info@kodeark.com.

Automatically, through cookies and similar technologies when you browse the Site — see “Cookies and analytics” below.

How we use your data

We only use your personal data where we have a lawful basis to do so:

  • To reply to your enquiry and discuss your project — legitimate interests, and to take steps towards a contract at your request.
  • To deliver a project once we’ve agreed to work together — performance of a contract.
  • To send you an update or piece of content you’ve asked for — consent, which you can withdraw at any time.
  • To keep the Site secure, measure how it performs, and improve it — legitimate interests.
  • To meet our legal and accounting obligations — legal obligation.

We don’t use your data to make automated decisions that produce legal or similarly significant effects about you.

Cookies and analytics

The Site uses Google Analytics to understand how visitors find and use kodeark.com — which pages are read, how people arrived, and roughly where visitors are located. Google Analytics uses cookies and similar technologies to collect this information, which Google processes in line with its own privacy policy.

Most browsers let you block or delete cookies through their settings. Blocking cookies may affect how some parts of the Site work, but it won’t stop you from browsing the Site or contacting us.

Who we share your data with

We don’t sell your data. We share it only with the service providers we rely on to run the Site and respond to you:

  • Resend — the email delivery service we use to route form submissions to our inbox.
  • Google Analytics — for Site usage analytics, as described above.
  • Our hosting and infrastructure providers, who process data on our behalf to keep the Site running.

Each provider only processes your data to provide their service to us, under their own data processing terms. We may also disclose data where required by law, or to protect the rights, property, or safety of Kodeark, our clients, or others.

International transfers

Some of the service providers we use (including Google and Resend) may process data outside the UK, including in the United States. Where this happens, we rely on appropriate safeguards, such as the UK’s International Data Transfer Addendum or adequacy regulations, to keep your data protected to UK standards.

How long we keep your data

We keep enquiry and project data for as long as we need it to respond to you, deliver any work you’ve engaged us for, and meet our legal and accounting obligations — typically no longer than 6 years after our last contact with you, unless we’re required to keep it for longer. Analytics data is retained according to Google Analytics’ standard retention settings.

Your rights

Under UK GDPR, you have the right to:

  • Access the personal data we hold about you.
  • Ask us to correct inaccurate or incomplete data.
  • Ask us to delete your data, in certain circumstances.
  • Ask us to restrict or object to how we process your data.
  • Ask us to move your data to another provider (data portability).
  • Withdraw consent at any time, where we rely on consent.

To exercise any of these rights, email info@kodeark.com. We’ll respond within one month. If you’re unhappy with how we’ve handled your data, you can also complain to the UK’s data protection regulator, the Information Commissioner’s Office (ICO), at ico.org.uk or on 0303 123 1113.

Keeping your data safe

We use reasonable technical and organisational measures to protect your data, including encrypted connections (HTTPS) and restricted access to the tools that store your data. No method of transmission over the internet is completely secure, but we work to protect your information at every stage.

Children’s data

The Site is intended for businesses and individuals seeking product or software services, and isn’t directed at children. We don’t knowingly collect data from anyone under 16.

Changes to this policy

We may update this policy from time to time, for example when we change how the Site works or when the law changes. We’ll update the “last updated” date at the top of this page when we do. Please check back periodically.
